This document is a public offer of Sell bai World LLC (the “Company”, the “Operator”) addressed to any legally capable individual or legal entity (the “User”), offering to conclude an agreement for the use of the website https://sb.sale (the “Website”, the “Platform”) and for making transactions through it. Any actions aimed at using the Website (registration, posting a listing, placing an order, payment) constitute full and unconditional acceptance of the terms of this offer.
1. Terms
- Platform — the software and hardware complex of the Website ensuring interaction between sellers and buyers.
- Seller — a user who places offers for the sale of goods and services on the Platform.
- Buyer — a user who purchases goods and services through the Platform.
- Order — a set of goods/services selected by the Buyer and confirmed by the Seller for shipment.
- Content — texts, images, descriptions, reviews, and other materials posted on the Platform.
2. Subject of the offer
The Company provides the User with access to the Platform — a marketplace where third parties (Sellers) place offers for the sale of goods and services, and Buyers can place orders. The Company acts as the operator of the Platform, ensures its technical operation and payment acceptance, but is not a party to transactions concluded between Sellers and Buyers unless expressly stated otherwise.
3. Registration and account
- Registration is required to use certain Platform functions.
- The User undertakes to provide accurate, complete, and up-to-date information.
- The User is responsible for keeping account credentials secure and for all actions performed under their account.
- The Company may block an account if violations, fraudulent actions, false information, or requests from competent authorities are detected.
4. Seller rules
- The Seller independently forms the assortment, prices, and sale terms, including shipment times and warranty obligations.
- The Seller must post accurate descriptions and photos, not violate third-party rights (copyright, trademarks, etc.), and comply with applicable law.
- The Seller is responsible for the quality, completeness, safety of goods/services, and compliance with Buyer rights.
- The sale of goods whose circulation is restricted or prohibited by the legislation of the Kyrgyz Republic and the recipient country is prohibited.
5. Buyer rules
- The Buyer places an order by providing accurate contact and payment information.
- The Buyer must timely pay for the order using the chosen payment method.
- The Buyer may refuse the order and request a refund in cases provided by law and by the Returns policy.
6. Prices and payment
All prices are indicated on product pages including applicable taxes and charges unless otherwise noted. Payment is made through payment providers connected to the Platform. The payment descriptor is SB.SALE. The Company may hold funds until order fulfillment is confirmed and carry out anti-fraud checks.
7. Delivery
Delivery is carried out using the method chosen by the Buyer. Timeframes and cost are determined by the Seller and/or delivery service. The Company is not responsible for the actions of logistics partners but assists in resolving disputes.
8. Return of goods and funds
The return procedure is described in a separate document — the Returns policy, which is an integral part of this offer.
9. Intellectual property
- All rights to the Platform software, design, logos, and trademarks belong to the Company or its licensors.
- By posting content, the User guarantees that they have the necessary rights and grants the Company a non-exclusive, royalty-free, worldwide license to use such content for the purposes of operating the Platform.
- Use of Website materials without the written consent of the Company is not allowed.
10. Liability of the parties
- The Company makes reasonable efforts to ensure uninterrupted operation of the Platform, but does not guarantee the complete absence of errors, failures, or interruptions.
- The Company is not responsible for the actions of Sellers and Buyers, the quality of goods and services, except in cases expressly provided by law.
- The Company’s liability is in any case limited to the amount paid by the User for the specific order giving rise to the dispute.
- The User is independently responsible for compliance of their actions with applicable law.
11. Personal data and cookies
Personal data is processed in accordance with the Personal data processing policy. Cookies are used in accordance with the Cookies policy.
12. Dispute resolution
The parties strive to resolve all disputes through negotiations. If settlement is impossible, the dispute shall be considered in accordance with the legislation of the Kyrgyz Republic at the location of the Company, unless otherwise established by mandatory consumer protection rules.
13. Changes to terms
The Company may amend this offer. A new version enters into force from the moment it is published on the Website. Continued use of the Platform after the publication of changes means acceptance of the new version by the User.
